Correct me if I am wrong, (IANAL) but would this not constitute a
blatant violation of the Privacy Act (1993) and also some other act (I
forget which one) from about 1961, as I recall... I remember doing some
research on an act regarding illegal collecting of evidence by police
about a month ago for my brother (long story short: it's illegal for a
police person to have a concealed tape recorder in his pocket/room/car
when you are being questioned, be it in or outside of the police
station, and if you are being recorded you must be notified, and
evidence to be given in court should preferably be on video and the
*original* copy should be shown, not a backup...)
I'm quite sure that they need some form of warrant or something like
that, otherwise you could probably also get them (if you happen to
detect an intrusion) under one of the computer information and security
acts as well. If deemed necessary I can probably find the relevant acts
and/or clauses within. From the information I have gathered, the only
way that they can legally search your computer is if they literally
seize the equipment (and they have to have some court order/warrant to
do that).
It's not a matter of the state giving themselves the right per se, I
think its more about the misinformation or lack of public knowledge with
regards to these (for lack of a better description) gestapo tactics - in
my brothers situation, if I hadn't told my mother & brother that what
the policeman had done to my brother was illegal, neither of them would
have known.
Again, correct me if I'm wrong (I may very well be interpreting the laws
incorrectly).
